Well, first off, .08 on a 400 pound dude is the same as on a 100 pound dude, its .08 percent of the blood and takes size into account, its just that it would take more alcohol for the big guy to reach it. Tolerance is the deciding factor in how drunk you are at any given BAC, and I don't know of any way to fairly test for tolerance.
But how on earth do you know the overall political stance based on one article on one issue? Oh yea, you wear a tinfoil hat and assume that everybody is out to get you. Is it totally outside of the realm of possibility that any of the people in the article might think that reasonable drug laws are a good idea?
