From the constitution:
The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed. Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791. No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. Amendment 6 - Right to Speedy Trial, Confrontation of Witnesses. Ratified 12/15/1791. In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence. What part of the above says that you can decide to name a defendant something else and then treat them differently under the law? The ONLY way that this would not apply is if they fall under the Geneva conventions, in which: Common article three states that noncombatants, combatants who have laid down their arms, and combatants who are hors de combat (out of the fight) due to wounds, detention, or any other cause shall in all circumstances be treated humanely, including prohibition of outrages upon personal dignity, in particular humiliating and degrading treatment. The passing of sentences must also be pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples. Article 3's protections exist even though no one is classified as a prisoner of war. That last sentence is particularly important, by the way. The constitution specifically does not mention citizenship as a requirement for a fair trial under the law. If they are being held by our government, they MUST be tried through a "Regularly constituted court" which, by definition, means that it must follow the requirements of our constitution. Including the right to trial by jury, a speedy trial, and proper indictments. |

Constitution applies to anyone inside the U.S. Or else my job would be a lot easier and I would never need probable cause to search stash-houses/cars/etc used by illegals You know, that whole 4th amendment and all. EDIT: This is more regarding your earlier post. there are always situations where things don't apply, but overall, its thought that all people have those rights whenever they are in our country. |
